Mooresville Mayor Chris Carney has filed a motion in court aiming to prevent WBTV from deposing him in an ongoing public-records lawsuit over surveillance footage taken inside town hall.
The motion, submitted by Carney’s attorney, argues that the video requested by WBTV depicts “personal conduct, not government business,” and may contain “images of him in a personal, and potentially embarrassing, position.” Because of that, the filing contends the footage should not be subject to public disclosure.
The dispute began in June, when WBTV sued the Town of Mooresville after officials declined to release surveillance video showing Carney and a communications consultant inside town hall at 4 a.m. on October 10, 2024. The station later issued a subpoena to depose the mayor, prompting his motion filed late last month.
Town officials maintain the footage is not a public record, arguing that surveillance recordings fall under law enforcement use and are therefore exempt from disclosure laws.
The lawsuit remains ongoing as both sides await the court’s next steps.
